PRIVACY POLICY
 
Privacy Notice pursuant to Personal Data Protection Act 2010 ("PDPA")

Collection of Personal Data

Pursuant to the requirement of the Personal Data Protection Act 2010 (hereinafter referred to as the “Act”), we are issuing this notice to all our valued Property Agents/ Consultants/Clients.

To comply with the Act, Champv Consultancy Sdn Bhd. (hereinafter referred to as “Champv”) is required to manage the personal data that we collect from you.

 Champv will collect and process your personal data as listed below which have/has been provided by you to Champv or any Champv’s personnel/ employees or through any banks or financial institutions:

 a) Name, job title and company name; b) Age, gender, date of birth, national registration identity card number, passport number;
c) Race, ethnic origin, nationality;
d) Contact information including address, email address and phone number;
e) Marital status, details of children, income range, employer;
f) Such other relevant information as may be requested by Champv ; and
g) Any personal data derived from any documents which you have given consent and/or not otherwise restricted to disclose information relating to you.

 (collectively hereinafter referred to as “the Personal Data”).

 

2) PURPOSE OF Champv COLLECTING YOUR PERSONAL DATA
 
Your personal data will be/is being collected, used and/or processed by Champv for, amongst other, the following purposes (“Purpose”): –
a) To comply with any legal or regulatory requirement relating to our provision of applicable law, regulation, direction, court order, by-law, guideline, circular, code applicable to Champv;
b) For the implementation, performance and completion of any services or transaction in connection with your engagement with Champv;
c) For delivery of notices, information updates, bills, receipts, invoices and other necessary correspondences to you;
d) For the maintenance and upkeep of Champv’s internal record, administration, management, business development, advertising, internal operations, data analysis and social activities;
e) For contact purposes;
f) To respond to your enquiries;
g) To provide services to you;
h) To enable you to provide goods/ services to Champv;
i) Matching any data held by Champv relating to the services provided by you and/or Champv and investigating complaints and suspected suspicious transactions; and
j) For such other purposes relevant to the services provided by you to Champv and/or by Champv to you.
 
 
3) DISCLOSING YOUR PERSONAL DATA
 
Champv will keep your personal data confidential but you hereby consent and authorize Champv to disclose your personal data to the following categories of parties:
a) Any person to whom Champv is required to do so by law or in response to a competent or government agency;
b) Champv’s business partners, affiliated companies, third parties and representatives in relation to providing you with Champv’s estate agency services and/or any commercial transactions;
c) Government agencies, statutory authorities and industries regulators; and
d) Champv’s auditors, consultants, accountants, lawyers or other financial of professional advisers.
 
We may also disclose the personal data if required to do so by law or in good faith, or if such action is necessary to (i) comply with requirements of any law enforcement agency, court
order or legal process; or (ii) protect and defend rights of Champv, its personnel and its related branches.

 

Please be informed that your personal data may be disclosed, disseminated and/or transferred to companies within Champv and its group member (including the holding company, subsidiaries, associated, related and affiliated companies as well as their subsidiaries, associated and affiliated companies), whether present or future (collectively, “the Group”) or to any third party organizations or persons for the purpose of fulfilling our obligations to you in respect of the Purposes and all such other purposes that are related to the Purposes and also in providing integrated services, maintaining and storing records.
 
 
4) SECURITY
 
To this end, we are committed to keep and process your data in a secured manner. We endeavour, where practicable, to implement the appropriate administrative and security safeguards and procedures in accordance with the applicable laws and regulations to prevent the unauthorized or unlawful processing of your personal data and the accidental loss or destruction of, or
damage to, your personal data. 
 
 
5) ACCESS AND CORRECTION TO YOUR PERSONAL DATA
 
It is your right as a data subject to have access and to correct your personal data in which you have provided to Champv and in this respect, you
may: –
a) Check if we hold or use your personal data and request access to your personal data;
b) Request for correction of any your personal data which in inaccurate, incomplete or not up to date;
c) Request for explanation on the policies and procedures in respect of your personal data provided to Champv;
d) Request Champv to limit the process of your personal data, including the personal data limiting to the person who may be identified from your personal data;
e) Inform Champv on your withdrawal (in full or in part) of your consent given previously to Champv subject to any applicable legal restrictions, contractual conditions and a reasonable duration of time for the withdrawal of consent to be affected.
 
Please note that we reserve rights to withhold access to your personal data in certain lawful situations and notify you of the reasons for not able to accede to your request.
